In brief, the house is still under a construction loan, as I refuse to go further into debt to make up for what the GC stole from me. So, the bank can either give me a regular mortgage with the house the way it is and I'll make improvements over time. Pay it off over 30 years. Or, they can foreclose and take the loss. It's up to them. They are taking 6 months to think about it. Que sera, sera.

Terrence - That really stinks.  I am so sorry about that mess.  We have watched house prices drop dramatically - the house next door which was purchased for 85M was going for 425M and is now down to 290M.  Scary the way real estate is fluctuating - almost as bad as the stock market.

Kathi you mean k right ? As in thousand ? Not m as in million ?  A 290 million house ?

Terrence, that sounds like an awful experience. 

I'm sure you've investigated this issue but is there no way the GC can be held liable?  Is he bankrupt?  It's probably a moot point now but things weren't so bad with the economy when you started building.

There is no law against being a bad business person. I went to his bankruptcy hearing. I ask him "Hank, what did you do with the money I gave you to pay the excavator guy?" His stock answer to everyone's question was: "I put it in my check book, and paid bills." I guess that's what his lawyer told him to say.
Nobody goes to jail for not paying their bills. There is no guilt or shame any longer for being a "deadbeat". Ah, the heck with it. I'll just claim bankruptcy like everyone else. In a couple of months I'll get all the credit card offers I can handle in the mail. That's why the economy is in such a state.

I thought when you declare bankruptcy your credit is shot for 7 years.

Russell, don't believe that. You have it tough for say about a year.
Or, even better, if you just pay your credit cards, forget the rent it takes almost a year to get evicted, the world is your oyster.
